Terms of Use

1. Agreement and eligibility

These Terms are an agreement between you and GetW8BEN (“we,” “us,” or “our”). By using the Service or purchasing a document, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into this agreement. If you use the Service for another person, you represent that you are authorized to provide their information and act for them.

2. What the Service does—and does not do

GetW8BEN provides a guided questionnaire that maps your answers onto an official IRS Form W-8BEN and lets you review a protected preview before buying the final PDF.

The Service is not affiliated with or endorsed by the IRS. General explanations and eligibility checks are educational and cannot account for every fact, treaty, law, or change in official guidance. If your situation is uncertain or complex, consult a qualified tax professional or the form requester.

3. Your responsibilities

You are responsible for:

• providing complete, current, and accurate information that you are entitled to use;
• deciding whether Form W-8BEN is appropriate for your circumstances;
• reviewing every generated field against current IRS instructions and correcting errors before purchase;
• printing or otherwise completing any required signature and certification date; and
• delivering the completed form to the appropriate withholding agent or requester, not to GetW8BEN or the IRS unless official instructions specifically require otherwise.

Do not rely on the Service for filing deadlines, treaty eligibility, withholding outcomes, or professional advice.

4. Anonymous sessions and purchase recovery

No account is required. Your form is linked to a signed browser session that normally expires after seven days. Clearing cookies, changing browsers, or losing access to the device may end browser access.

After purchase, Polar may provide a unique recovery key. Keep that key confidential: anyone who has it may be able to recover the purchased PDF. You are responsible for downloads and copies after they leave the Service. Retention and deletion periods are described in our Privacy Policy.

5. Price, payment, and delivery

The launch price is $10 USD for one completed W-8BEN PDF, paid once. There is no subscription, recurring charge, or automatic renewal. Applicable taxes may be added or reflected at checkout.

Polar hosts checkout and acts as merchant of record and authorized reseller. Your payment transaction is also governed by Polar’s Buyer Terms and Privacy Policy. Polar, not GetW8BEN, collects your payment credentials. We send Polar a form reference needed to fulfill the purchase, but not your form answers or generated PDF.

Payment unlocks the final, unwatermarked PDF for that completed form. It does not include professional review, electronic signature, submission, ongoing updates, or preparation of a different form.

6. Refunds

If the Service cannot correctly generate your form or you experience a technical problem, request a refund within 30 days of purchase by following our Refund Policy. We may ask for your checkout or order ID and a description of the issue. Do not email your full taxpayer identification number or completed form.

Nothing in these Terms limits refund, cancellation, or other consumer rights that cannot legally be waived.

7. Permitted use and intellectual property

We grant you a limited, personal, non-exclusive, non-transferable right to use the Service and your purchased output for lawful purposes. The official IRS form and other government materials remain subject to their own public-domain or licensing status. We retain rights in the Service’s software, design, guidance, selection, arrangement, and branding.

You may not interfere with or bypass security or payment controls; probe or overload the Service; use automated means to extract or reproduce the Service; introduce malicious code; misrepresent affiliation; use another person’s information without authority; or use the Service unlawfully. We may suspend access reasonably necessary to protect users, providers, or the Service.

8. Accuracy, changes, and availability

We aim to keep the Service aligned with supported IRS forms and guidance, but tax forms, instructions, treaties, and technical systems change. We may correct, update, limit, or discontinue features at any time. We do not promise uninterrupted operation or that every jurisdiction, treaty position, income type, or individual circumstance is supported.

If a generated document is unavailable because of our technical failure, your remedy may include regeneration or a refund under the Refund Policy. Keep your own copy after download.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that use of the Service will produce a particular tax, withholding, or acceptance outcome.

To the fullest extent permitted by law, GetW8BEN will not be liable for indirect, incidental, special, consequential, or punitive damages; lost profits or opportunities; rejection of a form; withholding decisions; penalties; or losses caused by inaccurate inputs, failure to review, or use outside the supported purpose. Our total liability arising from the Service will not exceed the amount you paid for the purchase giving rise to the claim.

These exclusions do not apply where prohibited by law and do not limit liability for fraud, willful misconduct, death or personal injury caused by negligence, or any right that applicable consumer law does not allow us to exclude.

10. Changes, disputes, and contact

We may update these Terms prospectively by posting a revised version and effective date. Terms in effect when you make a purchase will continue to govern that purchase unless a change is required by law or you agree otherwise.

Before starting a formal dispute, please contact us and give us a reasonable opportunity to resolve it. Nothing in these Terms prevents you from using a court, regulator, consumer-protection body, or other remedy available under applicable law. Mandatory rights in your place of residence remain unaffected.
